In Minnesota, every felony is assigned a severity level by the Sentencing Guidelines Commission, and that level - combined with criminal history - drives the presumptive sentence. This page lists every ranked offense by its level on the Standard, Drug, and Sex Offender grids, with the statute number for each, and explains how unranked offenses are sentenced. It reflects the 2025 Offense Severity Reference Table effective August 1, 2025.

Severity level is determined by the offense of conviction, not the charge. First-degree murder and certain sex offenses carry mandatory life sentences and sit outside the grids entirely.

Unranked Offenses
Some felonies are unranked — they are not assigned a severity level on the reference table. An offense is typically left unranked when it is rarely prosecuted, when it covers a very wide range of conduct, or when it is new and the severity of a typical case cannot yet be determined. Any offense omitted from the reference table is treated as unranked.
When the court sentences an unranked offense, it must assign an appropriate severity level for that case and state on the record why that level was chosen. In doing so, the court may look to the conduct underlying the offense, the level assigned to ranked offenses with similar elements, and how other offenders have been sentenced for the same or similar conduct. Because the level is set case by case, the sentencing analysis for an unranked offense is especially fact-dependent.

How is a felony's severity level decided in Minnesota?
The Minnesota Sentencing Guidelines Commission assigns each felony a severity level, listed in the Offense Severity Reference Table. The level is set by the offense of conviction, not the charge. That level, combined with the criminal history score, locates the presumptive sentence on the applicable grid.
What are the three grids?
The Standard Grid covers most felonies, ranked 11 (most serious) down to 1. The Drug Offender Grid ranks controlled-substance offenses D9 down to D1. The Sex Offender Grid ranks sex offenses A down to I. First-degree murder and certain sex offenses carry mandatory life sentences and sit outside the grids.
